NOTICE OF INTENTION TO FILE A CLAIM OF ABANDONMENT AND

EXTINGUISHMENT OF MINERAL INTERESTS

RCW 78.22.050

Legal notice is hereby given, pursuant to RCW 78.22.050, that the surface owners of the real property described below intend to file a claim of abandonment and extinguishment of mineral interests upon the expiration of a period of sixty (60) days after the last date of publication of this notice or the date service was perfected by personal service or registered mail on the current mineral interest owners, unless the current mineral interest owners file a statement of claim of mineral interest in the form prescribed in RCW 78.22.040.

A. Interest holders of record under that Statutory Warranty Deed, filed for record March 17, 1987, under Auditor's File No. 37762, in Deeds, Volume 69, page 506, records of Wahkiakum County, State of Washington: Helen L. Hunter, her heirs and assigns, address unknown.

B. The lands affected by the mineral interests to be extinguished are legally described as follows:

A tract of land located within Government Lot 7 of Section Twenty-Eight (28) and within Government Lots 2, 3, 5, 6, 8 and the Southeast Quarter of the Northwest Quarter (SE.1/4 NW.1/4) of Section Thirty-three (33), all within Township Ten (10) North, Range Eight (8) West of the Willamette Meridian, as situated within the County of Wahkiakum, State of Washington, being more particularly described as follows, to-wit:

COMMENCING at the 1/4 corner common to Sections Twenty-Eight (28) and Thirty-three (33), Township Ten (10) North, Range Eight (8) West of the Willamette Meridian, as shown on that particular survey recorded in Book 9 of Surveys, at Page 62, under Auditor’s File No. 2015975, in the records of Wahkiakum County, Washington; thence, South 89°41’04” West, along the line common to said Section 28 and 33, for a distance of 752.60 feet, more or less, to the line of Ordinary High Water on the Southeasterly side of Grays River, as shown on said survey, being the TRUE POINT OF BEGINNING; thence, Southerly along said line of Ordinary High Water for the following 8 courses:

South 41°37’01” West for a distance of 483.03 feet; thence, South 27°56’34” West for a distance of 670.44 feet; thence, South 13°46’44” West for a distance of 101.64 feet; thence, South 29°56’30” West for a distance of 171.91 feet; thence, South 37°10’37” West for a distance of 324.41 feet; thence, South 23°12’38” West for a distance of 1133.38 feet; thence, South 16°01’46” West for a distance of 591.35 feet; thence, South 06°51’21” West (said survey incorrectly shows S.06°51’21”E.) for a distance of 143.11 feet to the Westerly extension of an existing fence line; thence, leaving said line of Ordinary High Water, South 83°30’21” East, along said fence line and agreement line, for a distance of 1104.65 feet to a fence corner, as shown on said survey; thence, North 05°45’55” West, along an existing fence line and agreement line, for a distance of 1106.96 feet to a rebar and cap, located 120.00 feet Northerly of the South line of said SE.1/4 NW.1/4, as shown on said survey; thence, South 86°00’50” East, parallel to and 120.00 feet from said South line of the SE.1/4 NW.1/4, for a distance of 150.85 feet to a rebar and cap in an existing North-South fence line, as shown on said survey; thence, North 05°55’51” West, along said fence line and agreement line, for a distance of 328.73 feet, as shown on said survey; thence, North 00°41’05” West, along said fence line and agreement line, for a distance of 141.13 feet to the Southerly bank of an existing slough, as shown on said survey; thence, Easterly and Northerly along said bank of an existing slough for the following 8 courses:

North 66°29’56” East for a distance of 122.63 feet; thence, South 67°57’12” East for a distance of 143.86 feet; thence, North 85°37’42” East for a distance of 135.54 feet; thence, South 56°51’28” East for a distance of 167.36 feet; thence, South 80°31’12” East for a distance of 87.76 feet; thence, South 86°07’52” East for a distance of 163.80 feet; thence, North 39°59’32” East for a distance of 64.11 feet; thence, North 28°31’32” West for a distance of 87.55 feet to a rebar and cap in an existing East-West fence line as shown on said survey; thence, leaving said slough bank, North 89°21’55” East, along said fence line, for a distance of 348.24 feet to a rebar and cap as shown on said survey; thence, South 52°30’15” East, along an existing fence line, for a distance of 199.52 feet to a rebar and cap; thence, North 79°22’09” East, along an existing fence line, for a distance of 272.56 feet to a rebar and cap located on the West line of Lot 3 of that particular Short Subdivision filed under Auditor’s File No. 2009431, in the records of said county; thence, North 05°37’56” West, along the West line of said Short Subdivision, for a distance of 357.08 feet; thence, North 00°36’12” West, along West line, for a distance of 152.98 feet to the Southwest corner of Lot 1 of said Short Subdivision; thence, North 02°56’09” East, along the West line of said Lot 1, for a distance of 199.33 feet to the Northwest corner thereof; thence, continuing North 02°56’09” East, along the West line of an adjustment area conveyed under Auditor’s File No. 2018097, in the records of said county, for a distance of 224.11 feet to an existing fence line on the South side of an existing driveway; thence, South 72°28’07” East, along said fence line, for a distance of 398.57 feet; thence, South 43°46’08” East, along said fence, for a distance of 20.35 feet; thence, South 24°45’29” East, along said fence, for a distance of 80.96 feet to the North line of Lot 1 of said Short Subdivision; thence, North 87°58’31” East, along said North line, for a distance of 40.09 feet, more or less, to the line of Ordinary High Water on the Westerly side of Grays River; thence, along said line of Ordinary High Water for the following 3 courses, as shown on said survey:

North 07°34’37” West for a distance of 535.11 feet; thence, North 12°32’32” West for a distance of 429.00 feet; thence, North 20°00’00” West for a distance of 174.85 feet to the North line of Government Lot 2 of said Section 33, being N.89°41’04”E. a distance of 555.03 feet from the Northwest corner thereof (Point of Commencement); thence, continuing along said line of Ordinary High Water, located on the Southwesterly, Southerly and Southeasterly side of Grays River, for the following 6 courses:

North 34°03’37” West for a distance of 297.04 feet; thence, North 56°00’16” West for a distance of 227.43 feet; thence, North 82°11’06” West for a distance of 106.98 feet; thence, South 80°26’06” West for a distance of 155.27 feet; thence, South 67°06’52” West for a distance of 274.73 feet; thence, South 59°13’16” West for a distance of 512.69 feet to the TRUE POINT OF BEGINNING: containing 113.60 acres, more or less.

SUBJECT TO: Any road rights-of-way, private road and/or utility easements, restrictions, reservations, covenants or any other matters of record, if any.
