The Division II Washington State Court of Appeals on May 10 overturned the exceptional sentence of Andrue V. Riley and has remanded the case for new disposition before a different judge.
Riley had pled guilty to vehicular homicide and related charges stemming from a 2006 traffic accident in which he was driving while intoxicated. A companion died, and another suffered severe injuries.
Judge Michael Sullivan had ruled a manifest injustice had occurred and sentenced Riley to 2.5 years incarceration, longer than the standard range.
The appeals court overturned the manifest unjust finding and sent the case back for disposition before a different judge.
Wahkiakum County Clerk Barbara Blix said Wednesday that a new disposition hearing hasn't yet been scheduled.
