RESOLUTION NO. 1-2010

A RESOLUTION DECLARING AN ORDER OF WORK DUE TO FLOODING AND DIKE EROSION

 WHEREAS, the discussions and promises of the Columbia Land Trust and Ducks Unlimited, with their Kandoll Farm project have failed to resolve the problems of flooding, dike erosion, dike failure, floodwaters overtopping dikes along Seal Slough or floodwater retention due to winter storms and high tidal flows across private lands within the boundaries of the Grays River Habitat Enhancement District.

 WHEREAS, the aforementioned project demands immediate action to correct and protect the public health and safety and to provide relief to stricken families and lands within the Grays River Habitat Enhancement District.

 WHEREAS, the Kandoll Farm project was constructed with no regard to Wahkiakum County Ordinance #109-89 and #142-06, or with regard to zero-rise and flood plain reduction, nor House Bill 1441 passed on March 17, 1993 and Senate Bill 1441 passed on April 1, 1993 which provided for flood damage reduction.

 WHEREAS, the Grays River Habitat Enhancement District, a flood control and diking district under Washington state laws has the power to carry out the objects of their creation.

 WHEREAS, there is a condition present which necessitates immediate action.

 NOW THEREFORE, it is hereby resolved and ordered by the Board of Commissioners of the Grays River Habitat Enhancement District, as follows:

 Section 1: that it is hereby declared that there is work necessary due to upcoming winter storms and the continued erosion and failure of Seal Slough dikes within the boundaries of the Grays River Habitat Enhancement District; further the Commissioners of said District are authorized to take the necessary actions to correct such a condition and to enter into emergency contracts and incur obligations necessary to combat such conditions.
