ORDINANCE NO. 550-12

AN ORDINANCE OF THE TOWN OF Cathlamet, WASHINGTON, REPEALING CATHLAMET

MUNICIPAL CODE TITLE 13 IN ITS ENTIRETY, AND ENACTING A NEW Cathlamet MUNICIPAL CODE TITLE 13, PROVIDING FOR UTILITY

SERVICES IN AND BY THE TOWN OF CATHLAMET

WHEREAS, The Town of Cathlamet (Town) owns and operates drinking water and wastewater systems to serve its customers pursuant to applicable federal and state clean water and anti-pollution laws, and

WHEREAS, the Town has been advised by its consulting engineers and the Washington Department of Health (Health) and the Washington Department of Ecology (Ecology) to periodically examine and review its water and sewer ordinances to ensure that the Town's policies conform to current best engineering practices, health standards, anti-pollution rules, and financial methods for supporting its water and sewer systems, and

WHEREAS, the Town has diligently examined its current ordinances, many of which date back to 1982 and earlier, and found that many sections in Section 13 of the Cathlamet Municipal Code require significant revision, and

WHEREAS, the Town staff, consulting engineers, attorney, and Council Public Utilities Committee have sought to develop a comprehensive revision of the Town's Public Utilities Ordinance that conforms to current law and best practices, and

WHEREAS, the council has determined that foregoing certain initial water and sewer connection fees is justifiable in order to protect the public health and safety by reducing barriers to property owners connecting to the town’s drinking water and sanitary sewer systems,

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF Cathlamet AS FOLLOWS:

1. Cathlamet Municipal Code Title 13 is

 repealed in its entirety.

2. Cathlamet Municipal Code Title 13 is

 enacted as follows:

This ordinance shall take effect and be in full force on five days after passage and publication.
